Article 2 - SUBJECT

The subject of this agreement is the sale and delivery of the product specified below, with its characteristics and sales price, which the BUYER has ordered electronically from the SELLER's website "www.modadays.com," in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts Application Principles and Procedures, determining the rights and obligations of the parties.

Article 3 - SUBJECT OF THE AGREEMENT PRODUCT

The type, quantity, and sales price of the products are as stated on the website.

Article 4 - GENERAL PROVISIONS

4.1 - The BUYER declares that they have read and become knowledgeable about the basic characteristics of the product(s) subject to the contract, the sales price, payment method, and delivery information regarding the product(s) on the SELLER's website, and provided the necessary confirmation in the electronic environment.

4.2 - The product(s) subject to the contract will be delivered to the BUYER or the person/organization at the address indicated by the BUYER within the period specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal 30-day period.

4.3 - If the product(s) subject to the contract will be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible if the designated person/organization refuses to accept the delivery.

4.4 - The SELLER is responsible for delivering the product(s) subject to the contract in sound, complete, in compliance with the specified qualifications in the order, and with any warranty certificates and user manuals, if available.

4.5 - In order for the delivery of the product(s) subject to the contract to take place, it is necessary for the signed copy of this agreement to be delivered to the SELLER and for the payment to be made by the BUYER in the payment method of their choice. If the product price is not paid for any reason or is canceled in the bank records, the SELLER is considered to have been relieved of the obligation to deliver the product.

4.6 - If, after the delivery of the product, the BUYER's credit card is used by unauthorized persons unjustly or unlawfully, without any fault of the BUYER, resulting in the bank or financial institution not paying the product price to the SELLER, the BUYER is obliged to return the physical product to the SELLER within 3 days, provided that it has been delivered to the BUYER. In this case, the shipping costs for physical products are borne by the BUYER.

4.7 - If the SELLER is unable to deliver the product within the specified period due to force majeure or extraordinary circumstances such as adverse weather conditions or transportation disruptions, the SELLER is obliged to notify the BUYER. In this case, the BUYER can cancel the order, request a replacement with a similar product if available, and/or postpone the delivery period until the obstructive situation is resolved. If the BUYER cancels the order, the amount paid will be refunded to them in cash within 15 days.

4.8 - Individuals under the age of 18 cannot make purchases from the SELLER.

4.9 - The SELLER is not responsible for typographical and system errors resulting in price inaccuracies.

4.10 - The SELLER has the right to change or cancel the content, scope, and features of all products sold on the website.

4.11 - In case the order is realized, the BUYER is deemed to have accepted all the conditions of this agreement.

Article 5 - RIGHT OF WITHDRAWAL

The subject product/products are sold wholesale, therefore returns are not applicable.

Article 6 - COMPETENT COURT

In the implementation of this agreement, Consumer Arbitration Committees, up to the value announced by the Ministry of Industry and Trade, and Consumer Courts in the SELLER's place of residence are authorized.
